Welcome to guidio ("the Service"). Please read these Terms of Use ("Terms") carefully before using the guidio mobile application and website (https://classical.guidio.art).

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the Service.

2. Description of Service

guidio is a classical music library guide that provides metadata, organization tools, and discovery features for classical music.

AI-Generated Metadata Disclaimer

Most metadata provided by the Service is AI-generated based on various public data sources (such as IMSLP and Wikidata). While we strive for accuracy, metadata may contain errors or inaccuracies. The Service is intended as a companion for exploration and learning, not as a definitive academic source.

3. Account and Subscription

3.1 Account Creation

To use certain features, you must create an account using Apple Sign In. You are responsible for maintaining the confidentiality of your account information.

3.2 Subscriptions (Pro Plan)

The Service offers a "Pro" subscription plan that provides additional features such as unlimited piece additions to your library.

  • Payments: Subscriptions are managed through the Apple App Store.
  • Cancellations: You can manage or cancel your subscription at any time through your Apple ID settings.
  • Refunds: Refund requests are handled according to Apple's App Store policies.

4. Intellectual Property and User Contributions

4.1 Service Content

The Service’s design, features, and original content (excluding metadata from public sources) are the exclusive property of guidio and its licensors (third-party providers of fonts, software libraries, and other components).

4.2 Metadata

Metadata provided by the Service is aggregated from public sources and AI-processed. You may use this information for personal, non-commercial purposes within the app.

4.3 User Contributions and Data Refinement

By performing actions within the Service—such as tagging pieces, regenerating metadata, or providing feedback—you grant Guidio a non-exclusive, royalty-free, perpetual, and worldwide license to:

  • Aggregate and use this information to improve metadata for all users.
  • Provide this refined metadata as a uniform part of the Service.
  • Contribute such data (in an anonymized format) to public or open-knowledge databases such as IMSLP or Wikidata to benefit the classical music community.

5. User Conduct

You agree not to:

  • Use the Service for any illegal purpose.
  • Attempt to scrape, extract, or "harvest" metadata from the Service for use in other databases or for commercial purposes.
  • Reverse engineer or attempt to derive the source code of the mobile application.
  • Use the Service in any way that could damage, disable, or overburden our servers.

6. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including if you breach these Terms. You may delete your account at any time through the app settings.

7. Limitation of Liability

To the maximum extent permitted by law, guidio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use of the Service; (ii) any errors or inaccuracies in the AI-generated metadata.

8. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Japan.

Note for users residing outside of Japan: These Terms do not limit any mandatory consumer protection rights you may have under the laws of your country of residence (such as GDPR in the EEA/UK or consumer laws in the USA).

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Japan, unless mandatory local laws provide otherwise.

9. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes through the Service or via email. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
